Do You Know the Rules and Regulations Surrounding Alabama’s New Overtime Tax Exemption That Takes Effect January 1, 2024?
 
According to the Alabama Department of Labor, ‘for the tax year beginning on or after January 1, 2024, overtime pay received by a full-time hourly wage paid employee for hours worked above 40 in any given week are excluded from gross income and therefore exempt from Alabama state income tax.’
 
While that sounds simple enough, it just isn’t. There are many, many questions, including:



 

  • If the first pay period of 2024 includes time worked in 2023, when exactly do I stop withholding?
  • Is this rule applicable to hours my employee worked over 8 hours in one day or 40 hours in one week?
  • How does my employee’s paid time off taken during any pay period affect this rule?
  • Is my business or organization required to comply with this rule?
  • What are my reporting requirements as an employer?
  • How long will this exemption last? Is it permanent? Does it sunset?

Catherine ‘Ree’ Harper, a native of Bessemer, Alabama, received her Bachelor of Science in Business Administration (Accounting) from Auburn University in 1990. She was an officer and member of Beta Alpha Psi accounting honor society and worked with the Auburn Student Accounting Association and the University Programs Council. She began her legal career as a paralegal working in the areas of medical malpractice, worker’s compensation, insurance defense, and environmental litigation. Ree graduated with honors from Birmingham School of Law in 1996, where she was a member of Sigma Delta Kappa legal honor society and vice president of her class. The same year, she became a member of the Alabama State Bar.  She has practiced in various areas of business law including commercial litigation, creditor’s rights, and bankruptcy.  In 2010, she expanded her practice to include the design of human resource policies and practices focusing primarily on Form I-9 and E-verify compliance for client companies; conducting human resource and Form I-9 audits; and developing workplace policies and procedures.
Since joining the Professional Employer Organization (PEO) industry in 2018, in her role as General Counsel and Vice President of Human Resources, Ree now focuses on laws and regulations affecting small- to medium-sized employers and PEOs.  Her accounting and legal background, together with her expertise in employment issues, provide Lyons HR with a unique resource for our current and future clients.
Ree is highly involved with the National Association of Professional Employer Organizations where she is a member of the Board of Directors,  Legal Advisory Council, Federal Government Affairs Committee, and the State Government Affairs Committee.  She is an active volunteer with numerous community and church-related organizations.  Ree is based out of the Lyons HR Gadsden office.

The US Department of Labor continues to review a proposed minimum salary increase from the current $684 per week ($35,568 per year) to $1,059 per week ($55.068 per year). This minimum salary increase could impact some organizations’ positions, their titles and responsibilities, as well as the pay structure.
