COVID-19, Return to Work and the American’s with Disabilities Act

Returning to work during COVID-19 means returning to a “new normal”. What this “new normal” looks like will vary from business to business. However, when it comes to returning workers with disabilities and the American’s With Disabilities Act and Amendments (ADA), there are some common rules that should be followed to ensure a safe work environment while not discriminating against workers with disabilities. Please join us as we explore what “temporary” changes have been granted by the Equal Employment Opportunity Commission (EEOC) during the COVID-19 pandemic and what employers should know to keep from inadvertently discriminating against employees with disabilities.

Training Objectives:

Participants will

Review the definition of disability and understand who qualifies for reasonable accommodations under ADA
Become familiar with what medical tests are allowed related to COVID-19
Gain a better understanding of when a worker with a disability is, or is not, allowed to return to work and what actions may be looked at as discriminatory as it relates to the ADA

The Alabama Department of Rehabilitation Services is recognized by SHRM to offer Professional Development Credits (PDCs) for the SHRM-CP® or SHRM-SCP®.
